Victoria Police to Gain Expanded Powers as Knife Crime Rises – But at What Cost to Civil Liberties?

The Allan Labor Government has introduced the Terrorism (Community Protection) and Control of Weapons Amendment Bill 2024into Parliament, aiming to reduce knife crime across Victoria, including in areas like Wyndham. This legislation seeks to enhance police powers to search and seize weapons without a warrant, with less notice and for extended periods.

Currently, the Chief Commissioner of Victoria Police can declare a “planned designated area” in locations with a history of violence involving weapons, such as train stations, shopping centres, or event venues. This declaration permits police to search individuals and vehicles within the area. The proposed Bill expands this authority, allowing declarations based on intelligence suggesting a likelihood of weapon-related violence, enabling police to proactively address emerging threats.

In Wyndham, there have been several knife-related incidents highlighting the need for effective measures. For instance, in October 2024, a teenager allegedly armed with a knife caused a lockdown at Manor Lakes Shopping Centre. Although no injuries were reported, the incident raised community concerns about safety.

While the Bill aims to enhance public safety, it raises concerns about potential overreach. Allowing police to act on perceived threats could lead to subjective interpretations, possibly resulting in disproportionate targeting of certain communities or events. This is particularly concerning in diverse areas like Wyndham, where community trust is essential.

The legislation also proposes extending the duration of designated areas from 12 to 24 hours and reducing the minimum interval between declarations from 10 days to 12 hours. While this allows for a sustained police presence, it may lead to prolonged disruptions in public spaces, affecting daily activities and local businesses.

Additionally, the Bill removes the requirement to publish notices of planned designated areas in daily Victorian newspapers, opting instead for publication on the Victoria Police website. This change could limit accessibility for individuals without reliable internet access, reducing public awareness and transparency.

In September 2024, a 41-year-old individual was arrested in Point Cook after brandishing a knife, leading to a temporary lockdown of a local shopping centre. Such incidents underscore the need for effective policing but also highlight the importance of balancing safety measures with community rights.

While the government’s initiative addresses legitimate concerns about knife crime, it is crucial to consider the potential implications for civil liberties and community relations. Ensuring that enhanced police powers are exercised judiciously and transparently will be vital in maintaining public trust and effectively reducing crime in Wyndham and across Victoria.
