In short:
Victoria’s political donation caps have been blown up by a 15 April High Court ruling, after a challenge led by Wyndham’s Paul Hopper. The decision has ripped apart the state’s election funding system and sparked a political firestorm.
Landmark Ruling Causes Political Earthquake
West Party founder Paul Hopper has slammed Premier Jacinta Allan over her response to a landmark High Court decision that has torn up Victoria’s political donation laws.
The 15 April ruling by the High Court of Australia found Victoria’s donation caps — limiting individual contributions to just under $5,000 — were unconstitutional for burdening the implied freedom of political communication.
The case was brought by Hopper and former Independent candidate for Hawthorn Melissa Lowe, and has now forced a reset in how elections are funded in Victoria.

Premier Responds
Within hours, the Premier warned the decision had left the state exposed.
“The High Court’s decision to strike down Victoria’s long-standing electoral integrity laws leaves our state exposed to dark money in politics.
Right now, money could be flowing from foreign billionaires into political party bank accounts – with no limits, no disclosure, and no oversight.
The Government will immediately move to restore Victoria’s electoral integrity regime within the limits of the High Court’s ruling.
We can’t allow anyone to exploit this current period to solicit huge donations and move money around secretly.
Our legislation will make sure that every party and every candidate will be accountable for every dollar they receive from this day onwards.

Hopper Hits Back
Hopper then hit back, accusing both major parties of creating the situation they are now warning about.
“Labor and the Coalition can’t blame the High Court for the mess they put Victoria in”.
“I’ve read the Premier’s statement this afternoon, and I don’t believe she could have been surprised about today’s result,” Paul said.
“We warned the government that their rigged donation laws were unconstitutional and that if they didn’t fix them, we would have to go to the High Court.”
“The Premier called our bluff, we didn’t back down, and today she lost,” Paul said.
“Labor and the Coalition need to own the mess they have created.”
“By trying to rig the donation laws to serve themselves, the major parties have left us without the protections we all need before the next election.”

“The West Party supports transparency and is strongly opposed to donations from overseas sources.”
“But make no mistake, the major parties made this mess.”
“The High Court called them out. And now it’s up to the major parties to suggest solutions for the mess they have made.”
“And my promise to the people of Victoria is simple.”
“If the major parties try to introduce an un-level playing field, as they try and bring in any changes, we will be back to the High Court.”
“As for the Premier’s statement this afternoon, I guess she is saying whatever she can, to pretend this isn’t her own fault. But it is.”
The decision marks a major turning point, with a Wyndham-founded grassroots movement successfully challenging the political establishment and reshaping the rules of election funding across Victoria.
