Migrant Worker Incorrectly Paid
A Hoppers Crossing trailer manufacturing business and its director have been fined and ordered to back-pay a migrant worker after breaching workplace laws.
The Federal Circuit and Family Court has imposed $32,865 in penalties against Hoppers Trailer Pty Ltd and $6,573 against its sole director Gurpinder Singh, bringing total penalties to $39,438.
The penalties relate to the company failing to comply with a Compliance Notice requiring it to calculate and back-pay entitlements owed to a full-time welder employed between June and October 2022. Mr Singh was found to be involved in the breach.
The worker, an Indian national on a temporary graduate visa at the time, was not paid accrued but untaken annual leave at the end of his employment, as required under the National Employment Standards.
The court has also ordered the company to back-pay the worker $1,816, plus interest.
The Compliance Notice was issued in August 2023 after an investigation was triggered by a request for assistance from the worker. The company failed to comply with that notice, leading to court action.
